WHO CALLED THE COPS?

Hi, I am writing to you in reference to a question that was asked pertaining to "Who called the cops on my dog"? I understand that it is a violation to have you're dog outside barking repeatedly late at night!! Whenever my dog has to go to the bathroom we let her out!! While outside if she sees something that is bothering her or a threat to her family she will bark, whether it be an animal or a person that is not suppose to be there, it is a form of security especially when your spouse works nights or there have been more than an average amount of car thefts in the neighborhood!!
Well some neighbor must have called the cops to file a complaint about my dog barking and then called again (possibly other times within the week) If I remember correctly I might have had to sign a paper. I'm pretty sure that the law in NY states that the owner can allow the dog to go outside at any time but at 11pm and later the dog could not bark consistently for 15 minutes. Correct me if I'm wrong. The police officer came behind the door and said to me "I apologize for being here again because I see the problem is not your dog it is your neighbor."
   I know that you cannot accuse anyone of doing anything wrong unless you have proof? I never saw another police officer since, my dog was young (8years old), active, loved children and was a terrific watchdog!! She came in one day and collapsed on the floor after running and playing outside, eating well showing no signs of being ill, weak, or stressed. My dog died that night!!  This is while my neighbor's daughter was in the process on moving in with her mom and having an extension built. My children, myself, husband and relatives were sick, heartbroken and my neighbors also were extremely shocked to hear the bad news they didn't believe it!! The dog was so lively, alert and well behaved!! The night my dog died I had my suspicions that someone might have poisoned her so I took it upon myself to go outside and look under trees, behind bushes or near stoops looking for food that could have been left outside for my dog that could have been poison.
With flashlight in hand late at night not late enough where my neighbor would be sleeping but late enough that if someone were on you front lawn practically in front of your kitchen window while you were reading the paper, you would question it to why they were out there with a flashlight looking for something in fact I would have went to the front door and asked if they needed help looking for what they lost. My neighbors saw me being that they were up and looking out the window and I was in front of their house. Did they come to the front door and ask me what I lost or was looking for or if I needed help or maybe just put the light in front of their house to aid me. These neighbors are the kind of neighbors that when you are dressed for a special occasion, formal wear, meaning black and accented with other colors, being that black can be very attractive looking with blonde and red hair, have smiles on your face and posing in front of your house for a family picture, have the nerve to come up to you and ask if everything was all right did someone die in your family?? Now if you have enough of nerve to even question this don't you think that you would ask me what the hell I was doing outside on the front lawn bending down and looking through their bushes with a flashlight. My husband denies any wrong doing by these neighbors I feel only because my dog is dead and you can't accuse anyone of doing anything wrong unless you have evidence and we have to live here. At that time we didn't have a lot of extra money to have the dog autopsied and I didn't want to have the dog cut up so we don't know exactly what happened to her after playing and running and being frisky all day to come in the house and collapse. I had mentioned to a neighbor that week that my dog died and she didn't believe it she was really shocked. They asked me why and I said I didn't know she came in and collapsed they remember her being outside that week and seeing her being happy and playing. Being professional people that they are with every kind of degree you can think of they had mentioned out of the clear blue sky that I have a mean and nasty neighbor (this is without me saying anything about what I thought happened or went wrong) I swallowed my tongue and to make sure I heard this correctly I said who being that I live in between two neighbors. They pointed and their arms were extended out to the neighbor where I was on their front lawn with a flashlight. Educated people who live in a beautiful well kept home that make well deserved incomes and love their neighborhood and their side of the street. Why would these people say anything like that or risk saying anything like that being that I was very upset and if I went over there with a flashlight looking for evidence that it wouldn't stop me from going over there and accusing them of harming my dog and ruining everything and making an enormous amount of trouble for these people with all that they have at stake no one would say something like this if they didn't see or hear something. I respect my neighbors and would never say anything as to what they have told me or hurt them in anyway. This is why I decided to look up on the internet a way that I could find out who called the police on my dog??

Dear Unsigned,

I am a dog lover of the near crazy level. My pets are my “children.” You have my sincerest condolences.

That said, we move into the thinking zone where we have to accept laws and responsibilities.

If there is a leash law (most communities require dogs to be kept on your property or walked on a leash) and your dog was allowed to run free – you are in violation. Any neighbor is within his rights to make a complaint. You were not there to clean up after your pet. That is at least irresponsible and more than likely in violation of laws that REQUIRE owners to clean up after their pets.

You have to assess your legal position.

However, even if you are in violation, does that give anyone the right to poison your dog? I seriously doubt it. In my understanding, violating the leash law is a low misdemeanor; vindictive killing of someone’s pet can be a felony. (Check local laws.)

You have the right to seek any knowledge you wish regarding which neighbor called the cops? To the best of my knowledge, the police do not have to give you that information. So the question arises, what good will it do? It is unlikely that you will be able to prove your case even if you believe you know the culprit. You can not say for sure that the dog did not die of natural causes.
What do you expect to find while snooping around with a flash light - a chicken bone with fingerprints? You didn’t pay for an autopsy; are you up for a toxicologist and criminologist, or will the chicken bone say it all?
 
From my perspective, the best that can come of this, is a very tough lesson learned. Protect your pet at all times. WALK YOUR DOG ON A LEASH AND CLEAN UP AFTER HIM. That keeps you inside the rules and consistent with common sense.

You can blame anyone you want for any thing you want and pursue them the end of the earth, but if you had not let your pet out unattended, probably in violation of the law, definitely defying common sense and notification from the police, perhaps your dog would be alive today.
