I purchased a 2002 Acura RSX type S. I financed $29,000. Payment were $565 a month which I had no problem with until my ex hit me up for more child support. I then had to do voluntary repo. Bank sold the car for $13,000, when it was valued at $22,000 Bank took me to court for a balance of $12000.

I have tried working a deal with the bank’s attorney and he was going to run it by the bank but I have had no response as far as the bank’s answer. I looked up on a local website and I have missed 4 court dates. What can the consequences be of not showing up in court. Can I go to jail for this?

Thank you for sharing your voluntary repossession nightmare in this forum. I have tried to explain the natural result of auto repossession many times. Perhaps your misfortune can alert others.

A court judgment can result in a lien against tax refunds, bank accounts or any other asset within the court’s order and grasp. Failure to appear in court as ordered can result in a default judgment against you. It is sometimes possible to have the judgment vacated (set aside). Ordinarily, civil judgments do not result in incarceration. I doubt you will be threatened with incarceration for failure to appear, however, judges can be temperamental when insulted by defiance.
