CAN ATTORNEY SEND POLICE

Hello,

My question is: Can someone go to jail for having two auto repossessions? I
have attorney offices calling me and threatening to send a police officer to
my home and take me to court.  What happens if I get subpoena?

Dear Unsigned,

I have never heard of anyone going to jail for auto repossession. Nor do I know of broad attorney authority to send police. That said, attorneys may appeal to courts/judges/authorities for such actions. To the best of my understanding, powers of subpoena and arrest are vested in the courts, not the attorneys.

If the conditions of auto repossession reasonably indicate fraud, theft, or other illegal conduct, attorneys can appeal to courts for appropriate action.

If you do receive a subpoena, it will state a court appearance, surrender of documents, or other requirement. Your attorney can then take defensive action to protect you and your rights.

If an attorney has exceeded his authority with unsanctioned threats, he might be subject to a subpoena.

Only attorneys may offer legal advice. I am not an attorney. I am offering only a layman's opinion, not to be considered as legal counsel or advice.
